Of everything on a closing statement, title insurance is the line item buyers gloss over fastest. It sounds bureaucratic, it sounds optional, and it sounds like one more fee in a stack of fees. Let’s put on the broker-attorney hat for this one, because it’s none of those things — it’s the policy that protects the very thing you’re buying: your legal right to own the home at all.
Myth: Title insurance is just another line-item fee escrow tacks on to pad the closing costs.
Truth: Title insurance protects your actual ownership of the home — and without it, a problem from decades before you ever saw the property could put your ownership at risk.
Every home has a history — a chain of past owners, liens, easements, and legal claims stretching back, sometimes, a century or more. Title insurance exists because that history isn’t always clean, and the people buying a home today shouldn’t have to absorb someone else’s mistake from forty years ago.
What Title Insurance Actually Covers
Early in your transaction, a title company runs a title search and issues what’s called a Preliminary Report — technically just the title insurer’s offer to issue a policy, based on what they’ve found in the public record. Your review of that report is actually bundled into your due diligence period under the contract, right alongside your physical inspection of the property. Title insurance then protects against anything that search missed entirely — a forged signature decades ago, an heir nobody disclosed, an unpaid contractor’s lien that never got properly released.
If a covered issue surfaces after you’ve closed, the policy covers your legal defense and any financial loss tied to it, up to your policy amount.
Owner’s Policy vs. Lender’s Policy
Your lender will require a lender’s title policy, which protects their financial interest in the loan — not you. An owner’s policy is a separate purchase that protects your equity and your right to the home itself. In Los Angeles, it’s customary for the seller to pay for the buyer’s owner’s policy, but customary isn’t the same as guaranteed — it’s a specific point worth confirming in every contract rather than assuming.
Skipping the owner’s policy to save a relatively small amount at closing means your own ownership stake has zero protection if something surfaces later — only the lender’s interest does.
What a Title Search Catches, and What It Sometimes Doesn’t
Title searches are thorough, but public records aren’t perfect. Clerical errors, undisclosed heirs, fraud, and improperly recorded documents can all slip through, even with a careful search. That’s precisely the gap title insurance is built to cover — it’s not a backup for a sloppy search, it’s protection against the things no search, however careful, can guarantee against.
Real Scenarios Where This Matters
A previous owner’s unpaid contractor never filed a lien release properly. A long-lost relative resurfaces claiming an inheritance right to the property. A surveying error decades ago put a property line in the wrong place. None of these are common, but each has happened to real buyers — and in every case, title insurance is what stood between them and a serious financial loss, sometimes years after they’d already moved in.
What You Can Do
When you review your closing disclosure, don’t skim past the title insurance line — ask specifically whether you’re getting an owner’s policy, who’s paying for it, and what it covers. It’s a small conversation that protects what is, for most people, the largest purchase of their life.
